TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for award or variation of award

Australian Workers' Union
Tasmanian Branch

(T.3743 of 1992)

DAIRY PROCESSING AWARD

DEPUTY PRESIDENT A ROBINSON

HOBART 23 April 1992

Award variation - wage rates - State Wage Case August 1991 - 2.5% increase - granted

REASONS FOR DECISION

This matter concerns an application by the Australian Workers' Union, Tasmanian Branch to vary the Dairy Processing Award by increasing all wage rates by 2.5% together with supplementary condition of employment items required to satisfy the Wage Fixation Principles1 currently applying.

The two new condition clauses were categorised as:

1. a "requirement to work as directed" clause, and

2. a "productivity" clause.

The matter is one of consent and the two new award clauses complete, to the Commission's satisfaction, the fulfilment of all items contained in the Structural Efficiency Principle, (a) to (g) inclusive.

Based upon the evidence and submissions I am also satisfied that to grant the claim would be consistent with the public interest.

Accordingly it is my decision that the award will be varied by increasing all wage rates by 2.5%, appropriately rounded.

Date of Effect

The variation shall have effect from the beginning of the first full pay period to commence on or after 15 May, 1992.

Order

The parties requested to submit a draft of the Order.
