Industrial Relations Act 1984
s.23 application for award or variation of award

Australian Liquor, Hospitality and Miscellaneous Workers Union -
Tasmanian Branch

(T.4176 of 1992)

HOTELS, RESORTS, HOSPITALITY AND MOTELS AWARD

DEPUTY PRESIDENT A. ROBINSON

HOBART, 20 January 1993

Third minimum rates adjustment - Division B - Motels

REASONS FOR DECISION

This matter concerns an application by the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch, to vary the Hotels, Resorts, Hospitality and Motels Award by the granting of the third minimum rates adjustment to classifications contained in Division B - Motels.

The matter is one of consent and the parties have agreed also to increase "board and residence" allowable deductions following similar adjustment to like provisions in the parent Federal award.

The third minimum rates adjustment amounts are accepted as being consistent with public interest requirements pursuant to Section 36 of the Act, and they have also been framed in such a manner as to conform with current Wage Fixing Principles of this Commission.

In particular it is accepted that over award payments may be absorbed to the necessary extent.

Having regard for all of these circumstances I have decided to grant the application and vary the award in a manner consistent with the agreed draft order already prepared.

Date of Operation:

This variation to the award shall come into operation from the beginning of the first full pay period to commence on or after 1 February 1993.

The Order is attached.
