Award variation - clause 8 - wage rates - 4th and final minimum rates adjustment REASONS FOR DECISION This was an application by the Australian Municipal, Administrative, Clerical and Services Union (the Union) for a variation to be made to the Estate Agents Award (the Award). The Union sought the implementation of the fourth (and final) Minimum Rates Adjustment (MRA) for employees covered by Division A, Clerks, in the Award. An exhibit detailing the proposed increases was produced at the hearing in the form of a draft order. The Union reminded the Commission that the MRA process was introduced to the Award in July 1993 through application T4501 of 1993. At the time there was a schedule produced outlining the whole process. The Union formally requested that the fourth and final MRA be endorsed. The Union requested that this fourth MRA operate from 1 April 1995, that is, six months from the originally agreed commencement date for the third MRA. The Union also pointed out that its application in this matter had been lodged on 8 March 1995. The Tasmanian Chamber of Commerce and Industry (the Chamber) confirmed that the figures in the draft order were correct and its agreement to the amounts specified but, disagreed with the operative date sought by the Union saying the operative date ought to be 26 April 1995. The matter of the operative date was left to the Commission to decide and in granting the application the operative date was set at 17 April 1995. An order is attached.
