REASONS FOR DECISION

This matter concerns an application by the Tasmanian Chamber of Commerce and Industry Limited (TCCI) to vary the Laundry and Dry Cleaning Award by making provision in the Appendix for an employer named Daisy Fresh Dry Cleaners to make award superannuation contributions on behalf of its employees into a fund known as The Employee Retirement Plan. This arrangement to be in substitution for the requirement to make contributions to Tasplan.

No other organisations with an interest in this award attended the hearing and Mr Gates for the applicant advised the Commission that there had been correspondence with appropriate employee organisations and as a consequence they were fully appraised of the ramifications of the variation sought by TCCI.

Evidence was produced to demonstrate that The Employee Retirement Plan was a complying superannuation fund and is one which meets the wishes of employees as is required by Section 32 of the Industrial Relations Act 1984.

On the basis of the material before me I am persuaded to grant the application in the terms sought because I am satisfied that to do so would be consistent with public interest, with effect on and from 12 December 1995.
