Industrial Agreement - agreement approved - operative 6 January 2005 - to remain in force for a period of three years - forwarded to the Registrar for registration REASONS FOR DECISION [1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by The Australian Workers' Union, Tasmania Branchand Bonney Fox Pty Ltd, was for the purpose of filing an industrial agreement with the Commission. [2] On 16 December 2004, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Thursday, 6 January 2005 at 9.30 am. [3] The agreement, to be known as the Bonney Fox Rosebery Enterprise Agreement 2004, is to be operative on and from 6 January 2005 and remain in force for a period of three years. [4] The agreement applies to Bonney Fox Pty Ltd and its employees at the West Coast of Tasmania Operations and replaces and supersedes any awards or agreements previously in place at the Bonney Fox West Coast Tasmania Operation. [5] Having heard the submission of Mr Flanagan, on behalf of both the union and employer in this matter, I am satisfied that the agreement should be approved as it is consistent with the Wage Fixing Principles and does not offend the public interest requirements of the Act. [6] Pursuant to s.55(4) of the Act, the agreement will be operative on and from 6 January 2005 and remain in force for a period of three years, and I decide accordingly. [7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
