COMMISSIONER T J ABEY

HOBART, 22 February 2005

Industrial agreement - application approved - operative date ffpp 22 February 2005 - 2 years - forwarded to Registrar for registration

REASONS FOR DECISION

[1] On 7 February 2005, the Minister Administering the State Service Act 2000 and The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Department of Treasury and Finance Compliance Inspectors Industrial Agreement 2005.

[2] When this matter came on for hearing on 22 February 2005, Mr P Baker appeared for the Minister. Mr M Di Pretoro, with Mr P Davis, appeared for the CPSU.

[3] Mr Baker explained that this agreement was to replace the 1997 agreement.1

[4] Details of the translation process following the recent restructuring, together with the ongoing review process, were recorded in the transcript.

[5] Mr Di Pretoro said that the new agreement was an accurate reflection of the working arrangements within the Inspectorate and brought together a number of arrangements which had hitherto not been formally recorded.

[6] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] Pursuant to s.55[4] of the Act, the agreement is approved operative from the beginning of the first pay period to commence on or after 22 February 2005 and shall remain in force for a period of two years.

[8] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
