Industrial agreement - application approved - operative date 1 January 2005 - 3 years - forwarded to Registrar for registration REASONS FOR DECISION [1] On 19 April 2005, the Liquor, Hospitality and Miscellaneous Union - Tasmanian Branch (LHMU) and The Royal Agricultural Society of Tasmania (the Society) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, The Royal Agricultural Society of Tasmania (Outdoor Employees) Industrial Agreement 2005. [2] When this matter came on for hearing on 2 May 2005, Mr P Tullgren represented the LHMU. Ms J Thomas, of the Tasmanian Chamber of Commerce and Industry Limited, with Mr P Le Grove, represented the Society. [3] Mr Tullgren explained that this agreement arose as a consequence of a number of s.29 dispute notifications which had previously been before the Commission1. Should the agreement be approved, these earlier matters would be at an end. [4] Ms Thomas supported the submissions of Mr Tullgren and confirmed that adjustments to the Tool Allowance [Clause 8] would be from the same operative date as applicable in the Building and Construction Industry Award. [5] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act. [6] Pursuant to s.55 of the Act, the agreement is approved operative from 1 January 2005 and shall remain in force for a period of three years. [7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
