REASONS FOR DECISION

[1] These applications, lodged pursuant to s.55 and s.59(1) of the Industrial Relations Act 1984 by the Tasmanian Catholic Education Employees' Association (the union) and the Tasmanian Chamber of Commerce and Industry Limited for the Archbishop of Hobart (the employer), were for the purpose of:

· T12150 of 2005 - cancellation of the Tasmanian Catholic Education Office Education Officers Agreement 2004; and

· T12134 of 2005 - the filing of the Tasmanian Catholic Education Office Education Officers Agreement 2005;

with the Commission.

[2] The Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, before myself, to commence on Tuesday 12 July 2005 at 9.30 am.

[3] Ms A Briant presented submissions for the union; Ms J Thomas, Tasmanian Chamber of Commerce and Industry Limited, presented submissions on behalf of the employer requesting the cancellation of the Tasmanian Catholic Education Office Education Officers Agreement 2004, with the intention it be replaced with the Tasmanian Catholic Education Office Education Officers Agreement 2005.

[4] I am satisfied the agreement should be cancelled, and I so Order.

[5] The new agreement, to be known as the Tasmanian Catholic Education Office Education Officers Agreement 2005, is to be operative on and from 1 April 2005 and it is to remain in force until 31 December 2006.

[6] The agreement applies to all employees for whom classifications appear in the agreement employed by the employer at the Catholic Education Office.

[7] Ms A Briant presented submissions for the union and Ms J Thomas, Tasmanian Chamber of Commerce and Industry Limited, presented submissions on behalf of the employer.

[8] Having considered those submissions, I am satisfied the agreement does not offend s.36 of the Act or the Wage Fixing Principles and I approve the agreement.

[9] The files will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
