REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Health Services Union of Australia, Tasmania No. 1 Branch and the Tasmanian Deaf Society Inc., was for the purpose of filing an industrial agreement with the Commission.

[2] On 31 August 2005, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Tuesday 13 September 2005 at 9.30 am.

[3] The agreement, to be known as the Tasmanian Deaf Society Inc. (Salary Packaging Salary Sacrifice) Agreement 2005, is to be operative on and from 13 September 2005 and is to remain in force for a period of 3 years.

[4] Mr C Stringer for the Health Services Union of Australia, Tasmania No. 1 Branch and Mr G Roberts for the Tasmanian Deaf Society Inc. presented submissions in support of the application.

[5] Having considered the submissions of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[6] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
