IN THE TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984

T. No. 140 of 1985 IN THE MATTER OF an application by the Public Service Board to vary the PRISON OFFICERS' PRINCIPAL AWARD

In relation to the deletion of award provisions

COMMISSIONER J. G. KING HOBART, 11 June 1985

REASONS FOR DECISION

APPEARANCES:

For the Public Service Board - Mr. J. McCabe

For the Tasmanian Prison Officers'
Association
- Mr. G. Harris

DATE AND PLACES OF HEARING:

5 June 1985                    Hobart

This application by the Public Service Board (P.S.B.) sought to delete from the Prison Officers' Principal Award the classification of Medical Orderly Class I and II. It also sought the removal of a proviso relating to a special allowance for a Mr. B. P. McVilly.

At the hearing convened on 5 June 1985, Mr. McCabe for the P.S.B. advised that he did not want to proceed with that part of the application going to the deletion of the Medical Orderly classification.

In relation to the special allowance for Mr. McVilly, it was pointed out that he had been promoted to Deputy Nurse-in-Charge at the Prison effective from 16 May 1985. As a consequence of the promotion of Mr. McVilly, the allowance would no longer be paid. It was therefore appropriate that the enabling proviso be deleted from the award.

Mr. Harris for the Tasmanian Prison Officers' Association raised no objection to the submissions of the P.S.B.

As indicated at the conclusion of the proceedings on 5 June, the award will be varied as requested by the P.S.B. An appropriate order is attached. The date of operation to be the first pay period commencing on or after 5 June 1985.
