This application seeks a minor alteration to the conditions governing the granting of accumulated days off, following the introduction of a 38 hour week for prison officers.

The relevant part of Clause 10 - Implementation of 38 Hour Week of the Prison Officers Award (the Award) now reads:

"Shift Workers and Seven Day Shift Workers

By fixing one week day off per four weeks during the particular work cycle."

The variation sought reads:

"Shift Workers and Seven Day Shift Workers

By fixing one week day off equating to one day per four weeks during a particular work cycle."

The proposed amendment is agreed between the parties to overcome problems experienced with the current shift roster. More importantly a more effective new roster, proposed to commence early in 1987, requires the award variation before it can be introduced.

The overall effect of the variation will be a more efficient roster system with no change in the total number of days off over a given period.

In all the circumstances the Award will be varied, in accordance with the wishes of the parties, effective from the first pay period commencing on or after 16 December 1986.

An appropriate order is attached.

It goes without saying that I see no conflict with the Wage Fixation Principles or the public interest provisions of the Industrial Relations Act 1984 in this matter.
