The applications before me were for the purpose of varying the Laundrymens Award by increasing all wage rates contained therein by 4% pursuant to the Restructuring and Efficiency Principle.
The first full pay period to commence on or after 11 August 1988 was the agreed operative date.
The negotiated offsets are summarised as follows:
(a) Disputes Procedure
Disputes procedure provision to preserve the status quo whilst the procedure is followed.
(b) Annual Leave
Vary award to permit the taking of annual leave in 3 periods by mutual consent.
(c) Meal Allowance
Vary award to provide that a meal or meal allowance is not attracted until 2 hours overtime has been worked.
(d) Probationary Employment
Vary award to permit, in the first two weeks of employment, termination by either employer or employee on one hours notice or payment in lieu.
(e) Sick Leave
Vary award to allow employer to require production of a doctor's certificate where notice of absence is not given within one hour of the commencement time.
(f) Right of Entry
The unions to observe the award provision.
(g) Union Meetings
Union meetings, where practicable, to be held in such a way to avoid or minimise disruption to work.
(h) Spread of Hours
Vary the award to provide 6.30 a.m. to 6.00 p.m. span for ordinary time (excluding shift work).
(i) Shift Work
Vary the award by introducing a general shift work provision.
(j) Payment of Wages
Vary the award to allow the employer to determine the method of payment.
(k) Smoking in the Workplace
Smoking to be phased out in accordance with guidelines.
(l) On Site Discussions
On site discussions to be held to identify further restructuring and efficiency measures under the following headings
(1) Work Practices (2) Introduction of New Technology (3) Manning Levels (4) Demarcation (5) Production Levels (6) Hours of Work (7) General Conditions
It was Mr. Sertori's (representing the TCI) submission that whilst the agreed offsets were not quite cost neutral, nevertheless they were of significant value to the industry and were of such a nature that warranted a 4% increase to wage rates contained in the award.
I am prepared to accept the submissions of the parties and vary the award in the manner sought, including operative date as I am satisfied that a genuine attempt has been made to satisfy the requirements of the Wage Fixation Principles.
Order:
An order giving effect to this decision is attached.
