IN THE TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984

T.1194 of 1988 IN THE MATTER OF A MOTION BY THE TASMANIAN INDUSTRIAL COMMISSION PURSUANT TO SECTION 24(3) OF THE INDUSTRIAL RELATIONS ACT 1984

RE: RELEVANCE OF AWARD PROVISIONS IN THE BROADCASTING AND TELEVISION AWARD

COMMISSIONER R.K. GOZZI HOBART, 13 May 1988

REASONS FOR DECISION

APPEARANCES:

For the Musician's Union of Australia,
Hobart Branch
- Mr D.A. Cushion

For the Australian Theatrical and
Amusement Employees' Association
Tasmanian Branch
- Mr D.S. Shelverton

For the Tasmanian Confederation
of Industries
- Mr T.J. Edwards

DATE AND PLACE OF HEARING:

9 May 1988 Hobart

Since the inception of the Commission, the only activity in the Broadcasting and Television Award (the award) has been the adjustment of mostly outdated wage rates for classifications other than clerks. The reason for this is that the award was not maintained prior to the commencement of operation of the Tasmanian Industrial Commission.

Wage rates for clerks have been appropriately adjusted and maintained in the award.

In the circumstances this matter was listed for hearing at the motion of the Commission to ascertain if the award should continue in operation or be rescinded.

I was advised by Mr Fry that it is the intention of the Federated Clerks Union of Australia, Tasmanian Branch, to seek a Commercial Clerks' Award.

He indicated in his letter to the Commission that "arrangements have been made with our National Office to facilitate the attainment of this goal".

Mr Shelverton and Mr Cushion informed me at the hearing of their intention to seek registration in respect of the award.

Mr Edwards suggested that all the parties confer to develop a united position in respect of the award.

As it appears that there is some award activity contemplated by the parties, I will not initiate a rescission of those parts of the award which are currently completely out of date and which have no application to any employee.

The parties are aware of my intention to bring this matter on again towards the latter part of this year to ascertain progress made.

If, at that time, the award is still in its present form then in all likelihood the Commission will proceed as foreshadowed above.

For now, this matter is adjourned sine die.
