These two applications were heard simultaneously as both related to persons employed by the North West Regional Water Authority under the North West Regional Water Authority Employees Award.

Application T.1316 of 1988 sought to register an agreement containing restructuring and efficiency offsets in return for a 4% salary increase.

Application T.1392 of 1988 was for the purpose of having salary rates contained in the North West Regional Water Authority Employees Award reflect the 4% second tier increase.

The offsets contained in the agreement fall under the following headings:

1. Hours of Work
2. Overtime
3. Sick Leave
4. Non Cash Payment of Wages
5. Camping Allowance
6. Travelling Allowance
9. Meal Allowances
10. Abandonment of Employment
11. Uniforms
12. Grievance Procedure
13. Union Meetings
14. Special Leave - With Pay
15. Recreation Leave Allowance
16. Leave Without Pay For Accrual Purposes
17. Maternity Leave
18. Public Offices Closure

These offsets were the same as those considered and endorsed by the Full Bench when dealing with application T.1233 of 1988 and handed down on 24 March 1988.

I see no useful purpose rehashing the finer detail of the offsets as they have passed the test previously and in any case they are spelt out in the agreement.

I believe the offsets are sufficient to warrant varying the salary rates contained in the award by 4%. The offsets contained in the agreement reflect a genuine attempt by the parties to comply with the spirit and intent of the Principles.

The award will be varied in the manner sought and the agreement will now be referred to the Registrar with my approval so that he may finalise the registration of the agreement.

The operative date of the award variation will be from the first full pay period commencing on or after 20 June 1988. Order
