REASONS FOR DECISION

These applications, heard simultaneously, were made by the Tasmanian Public Service Association for the purpose of -

(a) registering an agreement with the Commission containing restructuring and efficiency offsets affecting certain employees of the Southern Regional Cemetery Trust; and

(b) varying the Southern Regional Cemetery Trust Staff Award by 4% to reflect the second tier increase under the Wage Fixing Principles.

The agreed offsets negotiated by the parties fall under the following headings -

1. Hours of Work
2. Overtime
3. Sick Leave
4. Non Cash Payment of Wages
5. Camping Allowance
6. Travelling Allowance
7. Walking Time
8. Wash Up Time
9. Meal Allowances
10. Abandonment of Employment
11. Uniforms
12. Grievance Procedure
13. Union Meetings
14. Recreation Leave Allowance
15. Leave Without Pay for Accrual Purposes
16. Maternity Leave
17. Public Offices Closure

These offsets were the same as those considered and endorsed by the Full Bench of this Commission when dealing with application T.1233 of 1988 and handed down on 24 March 1988.

It is not my intention, nor do I see any useful purpose going over the finer points contained in the offsets as they are detailed in the agreement.

Whilst recognising that not every offset will have an effect on the three employees covered by the agreement, nevertheless, I am satisfied that a genuine attempt has been made to comply with the Wage Fixing Principles.

The total cost of implementing the 4% second tier increase is $3,500 per annum.

As I am satisfied the agreement complies with the Wage Fixing Principles, it is my intention to refer it to the Registrar for finalisation and I decide accordingly.

Similarly, the salary rates appearing in the award will be varied by 4% to operate from the first full pay period commencing on or after 29 July 1988.

An order giving effect to this decision is attached.
