The applicant in this matter seeks the making of a new award to be known at the "Electrical Electronic Trades (Public Sector) Award" (the Award). The Award, if made, will have application to employees employed in accordance with the provisions of the Tasmanian State Service Act 1984, occupying a position classified in accordance with the proposed wage rates clause.

The affected employees have had their wages and conditions generally determined by the Minister for Public Administration (the Minister) in accordance with the Electrical Engineers Award of this Commission.

Mr Westwood in a detailed explanation of the proposed award, indicated the origin of the various provisions.

It follows from the above that the majority of conditions and wage rates had their genesis in the Electrical Engineers Award. Those that did not were in any case existing rates or conditions not provided for in that award. The other exceptions are changes which have now been agreed as offsets against the 4% second tier wage increase.

The agreed date of operation of the new award is the first pay period commencing on or after 15 September 1988 and the 4% second tier package from the first pay period commencing on or after the date of the Commission's decision.

I am satisfied that the proposed award and the 47 second tier package comply with the requirements of the Commissions Wage Fixing Principles. I therefore ratify the new award and the agreed date of commencement.

The 4% second tier package will apply from the first pay period commencing on or after 23 November 1988.

The Commission's order will follow in due course.
