T1685

IN THE TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984

T1685 of 1988 IN THE MATTER OF AN APPLICATION BY THE FEDERATED CLERKS UNION OF AUSTRALIA, TASMANIAN BRANCH TO VARY THE RETAIL TRADES AWARD

  RE: TRAINEESHIP CLAUSE FOR CLERKS

PRESIDENT 21 OCTOBER 1988

REASONS FOR DECISION

APPEARANCES:

For the Federated Clerks Union of
Australia, Tasmanian Branch
- Mr D Fry

For the Tasmanian Confederation of
Industries
- Mr T Edwards

For the Retail Traders Association - Mr J Blackburn

DATE AND PLACE OF HEARING:

14.10.88                       Hobart

In this application the Federated Clerks Union sought variation of an existing clause in the Retail Trades Award to provide for future employment of clerical trainees.

The variation sought was in line with the recent amendment1 which made provision for the employment of trainee sales assistants.

Both the Tasmanian Confederation of Industries and the Retail Traders Association endorsed the proposal. It was further agreed that the current traineeship provision be adapted to accommodate what was being sought. The parties indicated that an appropriate operative date would be 14 October 1988.

After hearing the parties, and having been given appropriate assurances that there would be no discrimination against existing full time employees, I have decided to vary the award in the manner requested with effect from 14 October 1988.

In establishing the operative date it should be made clear that this amendment is intended to apply to Clerical Trainees and will in no way affect the current provision regarding Sales Assistant Trainees.
