This application seeks to vary the Cement Makers Award (the Award) by the inclusion of a new classification as follows;

"By varying section III by inserting the classification 13 Rigger $306.00 and renumbering existing classifications 13 to 19 to 14 to 20 respectively."

Section III, relates to day workers in Divison A of Clause 8 Wage Rates, of the Award.

Following preliminary discussions on the day of the hearing, the application was subsequently amended by seeking to include the new classification (rate) in Section V - Auxiliary Services in lieu of Section III - Day Workers.

The effect of the change is to increase the existing Rigger classification wage rate in that Section by $2.50 per week.

I was advised that the reason for the above change was that the employer (Goliath Portland Cement Company Limited) did not want two classifications of Rigger in the Award. The end result of such a situation could be varying rates and the same problem that this application was designed to prevent i.e. the switching of union membership to achieve a higher rate of pay.

I was also advised that the proposed new rate was in fact the rate that is being paid by the employer, thus there was no offence to the Commission's Wage Fixation Principles if the claim was granted.

The date of operation, which in any case has no effect on pay packets, is agreed, as the date of the Commission's decision.

The attached order therefore operates from the first pay period commencing on or after 9 November 1988.
