T1705

IN THE TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984

T.1705 of 1988 IN THE MATTER OF AN APPLICATION BY THE TRANSPORT WORKERS' UNION OF AUSTRALIA, TASMANIAN BRANCH TO VARY THE CARRIERS AWARD

  RE: ALLOWANCES

COMMISSIONER J G KING HOBART, 14 November 1988

REASONS FOR DECISION

APPEARANCES:

For the Transport Workers' Union
of Australia, Tasmanian Branch
- Mr B. Hansch

For the Tasmanian Confederation
of Industries
- Mr K Brotherson

DATE AND PLACE OF HEARING:

1 November 1988           Hobart

This application seeks to vary the Carriers Award (the Award) by increasing nominated allowances by 3%.

Mr Hansch submitted that the allowances could be increased, by the last National Wage movement, in accordance with the Wage Fixing Principles.

Mr Brotherson raised no objection to the application.

I accept the agreement of the parties, however, for the future I indicate that I do not believe the Principles envisage adjustment of these and similar allowances after every National Wage Case.

The appropriate part of the Allowances Principle reads:

"(a) (ii) Existing allowances which relate to work or conditions which have not changed may be adjusted from time to time to reflect national wage increases..."

    (underlining mine)

I believe the intent of the above is clear.

The agreed date of operation of the Commission's order is the first pay period commencing on or after 1 November, 1988.
