These applications seek to vary both the General Conditions of Service Award and the Advanced Education Service Award in respect of improved kilometreage rates.

Both are matters of consent and rely upon the substance of Full Bench decision T.33 of 1985 and the existence of award provisions enabling periodic adjustments to be made at nominated intervals and based upon a pre determined formula.

Since the establishment of the original basis for adjustments there is an established history of the Commission following the arbitrated formula from time to time.

In my view this is a cost related allowance and to now vary each of the awards in the manner sought would be entirely consistent with current wage fixation principles and public interest criteria.

The claims are therefore granted.

OPERATIVE DATE

Both the Tasmanian Public Service Association and the Minister for public Administration agree to the retrospective adjustment of this variation and it will therefore be effective from the first full pay period to commence on or after 26 October 1988.
