This matter concerns an application to vary Clause 8F - Foul and Nauseous Linen Allowance, subclause 2 - Utility Officer - Risdon Prison, of the General Conditions of Service Award.

The effect of the variation sought is to extend an existing award provision relating to the classification of "Senior Utility Officer" to also include a "Trade Instructor" who is regularly required to carry out the same duties.

The parties indicated this is a consent matter and in fact "Trade Instructors" are already being paid the allowance in appropriate circumstances as "higher duties".

In the circumstances the application has merit on the evidence of the parties and it is therefore right and proper that where identical circumstances prevail that an existing allowance once properly determined be applied equitably.

I accept that the Principles present no impediment to granting the claim, nor would public interest criteria be offended.

For all of these reasons the claim is granted.

OPERATIVE DATE

As from the first pay period to commence on or after 12 December 1988. Order is attached.
