This application concerned the introduction of a 38 hour week into Division B - Employees of Residential Homes For The Care Of Children Other Than Those Provided For In Division A of the Welfare and Voluntary Agencies Award (the Award) or Division E of the Hospitals Award.1

Mr Holden appearing for the Hospital Employees' Federation of Australia, Tasmania No 2 Branch submitted that whilst all of the other Divisions of the Award had been varied in respect of a 38 hour week, Division B was overlooked.

Division B has known application only to employees employed by Roland Boys Home, Sheffield and Clarendon Childrens Home, Kingston Beach.

According to Mr Sertori who appeared for the Tasmanian Confederation of Industries, the Homes involved employ a "handful" of employees only. He estimated that a total of around ten employees would be affected by the change to the Award.

Mr Sertori indicated that the possible reduction in hours was first mooted with employers "as far back as 1985" and that the offsets document (exhibit H1) reflected the outcome of negotiations over a considerable period of time.
