This decision deals with the 4% second tier claim (part of both applications) with the 3% superannuation and 38 hour week matters stood aside for further consideration by the parties.

The parties are agreed that all wage rates contained in the award should be varied by 4%, effective from the first pay period commencing on or after 15 March 1989.

Exhibit B1 details the award changes which have been negotiated as a cost offset against the 4% increase.

Changes have been agreed affecting the following clauses:

1. Overtime;
2. Hours of Work;
3. Sick Leave;
4. Annual Leave;
5. Payment of Wages.

While no attempt has been made to cost the savings that will be achieved by the variations, I am satisfied that the parties have made a genuine attempt to comply with the requirements of the second tier Principle.

The award will therefore be varied as agreed between the parties.

The Commission's Order No. 1 of 1989 (Consolidated) and Order No. 2 of 1990 is attached.
