IN THE TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984
On 7 February 1989 I handed down a decision which (a) inserted a new classification in the Agriculturists Award for employees operating a range of mechanical harvesting machines used in the harvesting of peas and/or broad beans and/or green beans; and (b) included in the award a shift loading of 15% for work carried out by the same employees when that work is performed during shifts commencing after 6pm and before 6am. In relation to the operative date of that decision, I had the following to say: "I was asked by the parties not to determine an operative date at this time as they would prefer to place a separate submission on that question after having the benefit of seeing my decision. This being the case, I now give the parties notice that this hearing will be reconvened on Thursday, 2 March 1989 to enable submissions to be presented on the operative date." As a result of that hearing, I am now in a position to finalise the operative date. The parties presented an agreed position which, given the seasonal nature of this work, receives my support and that is -
