This application by the Federated Clerks Union of Australia (Tasmanian Branch) seeks the variation of Division A of the Estate Agents Award in respect of the 4 per cent second tier, a change to the Hours of Work clause to enable further discussions to take place on the method of working a 19 day month and the introduction of 3 per cent superannuation provisions.

In the proceedings matters relating to superannuation were adjourned to enable the parties to further discuss that part of this application.

This interim decision therefore endorses the offsets negotiated for the pay increase and the change in Spread of Hours for all employees except those in the City of Hobart and City of Glenorchy.

I acknowledge that the parties had difficulty in achieving the level of offsets the Commission as constituted in these proceedings would normally endorse.

However I am persuaded that a genuine attempt has been made and some award offsets have been put into place.

Mr Brotherson informed me that the award already provides a great deal of flexibility and that the employers considered that to alter the award for no good reason could indeed reduce the latitude of employers.

Brotherson also requested that I recognise the time that has elapsed since the 2nd tier principle became available. This he said should also be given a value.

In all of the circumstances I have decided to vary the award operative from the first pay period to commence on or after 1 July 1989.
