This application by the National Union of Storeworkers, Packers, Rubber and Allied Workers concerns the variation of the Produce Award in respect of the inclusion of 3 per cent superannuation provisions.

The draft order submitted by Mr Sertori was amended during the course of the proceedings by the Commission indicating that exemption applications, in the event that they are made, will be determined by the Commission and not otherwise.

Employers who are not members of an employer organisation will be able to seek the involvement of the Commission in accordance with Section 29 of the Act.

The terms of the proposed order, as varied by the Commission in respect of the mechanics for exemption applications, meets the requirements of the Superannuation Wage Fixation Principle.

I have also decided to endorse Tasplan and the Labour Union CoOperative Retirement Fund as being the appropriate funds for this Award.

I accept that in respect of several employers in this State that LUCRF is the fund already in place and that it would be inappropriate in this case to alter those arrangements.

I note that LUCRF is the fund applicable in the Wool Industry Award which has application to some employers who also have employees whose employment is regulated by the Produce Award.

My order, operative from the first pay period to commence on or after 1 July 1989 is attached hereto.
