DATE AND PLACE OF HEARING:

 

8 December 1989 Hobart

On 21 July 1989, Mr. T. Abey for and on behalf of the Tasmanian Confederation of Industries, made application to vary the Fibreglass and Plastics Award.

When the hearing commenced, Mr. Abey amended his application to vary Clause 2 - Scope of that award to read as follows:

    "2. SCOPE

    This award is established in respect of the industry of processing or manufacturing fibreglass and plastic articles (other than plastic articles subject to the Leather, Canvas and Sheet Plastic Fabrication Award)".

All other clauses sought to be varied in the original application were withdrawn.

There was no objection from any party attending the hearing to vary the `Scope' clause as sought by the applicant.

In view of the decision of the Commission arising out of application T2239 of 1989, there is a need to qualify the 'Scope' clause in this the Fibreglass and Plastics Award to make it perfectly clear that it does not include the industry falling within the `Scope' of the Leather, Canvas and Sheet Plastic Fabrication Award.

For this reason, the application is endorsed by the Commission and the award will be varied in the manner sought by the parties.

The Order giving effect to this decision will take effect from the first full pay period commencing on or after 1 January 1990 which coincides with the operative date of implementation of the Leather, Canvas and Sheet Plastic Fabrication Award and will be incorporated in the consolidated Order arising from the State Wage Case decision which was operative from the first full pay period to commence on or after 23 November 1989.
