IN THE TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984

T2097 of 1989

IN THE MATTER OF AN APPLICATION BY THE FEDERATED CLERKS UNION OF AUSTRALIA, TASMANIAN BRANCH TO VARY THE INSURANCE AWARD

RE: CASUAL EMPLOYEES

COMMISSIONER R K GOZZI

HOBART, 10 November 1989

REASONS FOR DECISION

APPEARANCES:

For the Federated Clerks Union
of Australia, Tasmanian Branch

- Mr D Fry

For the Tasmanian Confederation
of Industries

- Mr T Edwards

DATE AND PLACE OF HEARING:

23 October 1989   Hobart

In this matter the Federated Clerks Union of Australia, Tasmanian Branch (FCU) sought the variation of the Insurance Award to incorporate in Division B a definition for the rate of pay for casuals.

As the award makes no reference to this particular aspect, the application was advanced by Mr Fry ostensibly as a "tidying up" exercise.

The proposed variation was agreed to by Mr Edwards appearing for the Tasmanian Confederation of Industries (TCI) who informed the Commission that he had taken detailed instructions from members of the TCI required to observe the award.

The variation does no violence to the wage fixing principles of the Commission. Indeed the inclusion of a definition setting out how casual employees must be paid is in the public interest.

The variation is endorsed operative from the date of this decision.

The appropriate order is attached.
