This application seeks to vary the General Conditions of Service Award by increasing the Kilometreage Allowances already provided in that award.

And such application relies upon subparagraph 2.4 of Clause 8 which provides as follows:

"The rates specified in subparagraphs 2.1 and 2.2 shall not be varied as a consequence of National Wage Case decisions. The rates shall be varied upon application subsequent to 30 March and 30 September of each year after the Hobart Transportation, Private Motoring subgroup, Consumer Price Index Numbers for the quarters ending 30 March and 30 September respectively, become available. The Rate 1 and Rate 3 variations for the first 10,000 kilometres travelled shall be calculated in accordance with the formula specified in decision T.33 of 1985 dated 13 June 1985.

Variations to the other rates specified in the tables in subparagraphs 2.1 and 2.2 shall be calculated by applying the percentage shown in brackets to the relevant first 10,000 kilometres rate (as varied) shown in 100%."

Similarly the application relies upon the formula specified in Full Bench decision T. No 33 of 1985.

The matter is one of consent, save for the question of operative date.

I am satisified that the claim is based upon proper criteria already determined by this Commission; meets the requirements of current Wage Fixation Principles; and is consistent with the requirements of Section 36, public interest.

The claim is accordingly granted.

OPERATIVE DATE

This variation shall have effect from the beginning of the first full pay period to commence on or after 29 August 1989.
