RE: SUPERANNUATION EXEMPTIONS

COMMISSIONER R.K. GOZZI

HOBART, 1 September 1989

REASONS FOR DECISION

APPEARANCES:

For the Federated Miscellaneous
Workers Union of Australia,
Tasmanian Branch

- Mr K. O'Brien

For the Tasmanian Confederation
of Industries

- Mr M. Sertori

DATE AND PLACE OF HEARING:

28 August 1989  Hobart

This application by the Tasmanian Confederation of Industries seeks the variation of the Laundrymens Award to include a provision for the exemption from the requirement for the employer to contribute occupational superannuation payments to the nominated fund in the award which is Tasplan.

Specifically the exemption application relates to the inclusion in the award of the Australian Retirement Fund (ARF) to be utilised by Lukes Coastal Laundry (the employer).

The employer operates a number of businesses including West Coast Cleaning Contractors. The employees in that business have their employment regulated by the Cleaners Award which contains the ARF as the nominated fund.

As the majority of this employers's employees have their contributions paid into ARF, I agree with the submissions of both Mr Sertori and Mr O'Brien that it is desirable for the employer to contribute to this fund for all employees.

My order, operative from the first full pay period to commence on or after 12 May 1989, will issue shortly.
