In this matter, an application by the Association of Draughting, Supervisory and Technical Employees, Tasmanian Branch (ADSTE) for the making of the Draughting, Supervisory and Technical Officers (Private Industry) Award, I issued an interim decision1 where I outlined the background to this application which stemmed from a declaration2 made by the President.

I also indicated in my interim decision that the award requested to be made satisfied the "first awards" principle and subject to certain modifications of a machinery nature I would endorse the draft order submitted by the parties.

All of the amendments required to be made have been attended to by the parties and are incorporated in exhibit ADSTE 2; a draft order.

Accordingly, and having regard to public interest considerations, the award will be made operative from the first pay period to commence on or after 23 October 1989.

The award also contains occupational superannuation provisions which were discussed in my interim decision. These provisions are endorsed operative from 1 December 1989.

The parties are aware that the seeking of exemptions from the nominated fund in the award i.e. TASPLAN has been held over for those employers who as at 1 December 1989 are already contributing to an approved fund.

Therefore, as the award has now been made it will be necessary for the parties to make application to vary the award in respect of those employers as indicated in the Occupational Superannuation clause in the award.

The order is attached.
