Application T2184 of 1989 was made by the Federated Clerks Union of Australia, Tasmanian Branch for the purpose of varying the Building Trades Award in relation to 3% superannuation, a 4x second tier increase and a 38 hour week for Division G - Clerks.

At the outset of the hearing Mr. Grubb, representing the FCU, sought and was granted leave to adjourn the 41 second tier increase and the 38 hour week matters sine die.

The applicant tendered an exhibit which took the form of a draft order going to the provision relating to superannuation.

I was informed that the parties had reached agreement on the contents of Exhibit FCU1 with an operative date from the first full pay period to commence on or after 15 January 1990.

The inclusion in the award of a provision for occupational superannuation as outlined in Exhibit FCU1 conforms with the Wage Fixing Principles and therefore receives the endorsement of the Commission. However, I do point out that I do not support the procedures for exemption as shown in the draft order and I have made some slight modifications to be consistent. with the requirements of the Act.

The Order giving effect to this decision shall be incorporated in the Order arising out of matters T2138 and 2150 of 1989.
