In this matter the Federated Clerks Union of Australia, Tasmanian Branch responded to the request by the Commission to make an application for the variation of Division A of the Estate Agents award to include a designated exemption following Section 29 proceedings in T.2157 of 1989.

The designated exemption is for Acushla Pty Ltd trading as David Anderson Real Estate.

I now confirm that the award variation will be made to enable Acushla to be exempted from the nominated fund (Tasplan) cited in the award.

As indicated in my decision in T.2157 of 1989 the fund now exempted from Tasplan, i.e. the Mercantile Mutual Life Master Fund complies with the Commonwealth Operational Standards for Occupational Superannuation.

The operative date for this variation will be the first pay period to commence on or after 1 October 1989.
