IN THE TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984
This matter is one of long standing, having been lodged with the Commission on 5 November 1987. It concerns an application by the Clothing and Allied Trades Union of Australia to vary the Clothing Makers Award by the addition of a new schedule to provide for coverage of contract work performed by "outworkers". The file indicates that when the matter was first heard by Commissioner King the parties expressed a wish to, as far as possible, mirror Federal award provisions in relation to the same subject matter when eventually made. Particular reference was made to the Federal Clothing Trades Award, 19821. Consequent upon the finalisation of that award the parties, with the Commission, identified areas in the Order which required special attention by virtue of differences in the two jurisdictions. And a prime example concerned the use of boards of reference. In due course a consent document was settled upon by the parties and submitted for ratification. Since the Australian Industrial Relations Commission and the Tasmanian Industrial Commission are equally concerned with compliance with a set of Wage Fixations Principles and are equally required to have regard for the public interest, I am satisfied from my reading of the transcript, the submissions made to me, and my examination of the documentation that all relevant criteria have been met. Accordingly the application is approved. OPERATIVE DATE The variation shall have effect from the beginning of the first pay period to commence on or after 23 December 1989. Order will follow.
