IN THE TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984

T.2274 of 1989

IN THE MATTER OF AN APPLICATION BY THE FEDERATED MISCELLANEOUS WORKERS UNION OF AUSTRALIA, TASMANIAN BRANCH TO VARY THE LAUNDRYMENS AWARD

RE: OVERTIME DIVISOR

COMMISSIONER R.K. GOZZI

HOBART, 8 February 1990

REASONS FOR DECISION

APPEARANCES:

For the Federated Miscellaneous
Workers Union of Australia,
Tasmanian Branch

- Mr K. O'Brien

For the Tasmanian Confederation
of Industries

- Mr M. Sertori

DATE AND PLACE OF HEARING:

6 February 1990  Hobart

This application by the Federated Miscellaneous Workers Union of Australia, Tasmanian Branch seeks to vary the Laundrymens Award by inserting the 38-hour divisor in the relevant overtime provision of the award.

When the award was varied1 in July 1987 in respect of the introduction of the 38-hour week, the parties at that time agreed that the 40-hour overtime divisor would remain in place for a period of twelve months.

As it transpired the award was not varied at the expiry of the twelve month period.

This application seeks to rectify that oversight.

Accordingly the award will be varied to delete the 40-hour divisor contained in Clause 19(c) - Overtime and be replaced by the 38-hour divisor.

The operative date will be from the first pay period to commence on or after 1 July 1988.

The order is attached.
