This application arose as a consequence of my decision in matters T.2134, T.2195 and T.2196 of 1989 in which a number of occupational superannuation fund exemptions were made. The applicant, the Tasmanian Confederation of Industries (TCI), for which Mr Ken Brotherson appeared, sought an amendment to the Public Accountants Award to allow for a number of businesses to be exempt from contributing to the superannuation funds specified in clause 17 of the award: the businesses were to be named in the award together with the alternate funds to which they would be required to contribute. Mr Brotherson also sought and was granted leave to amend his application to have the name "Institute of Affiliate Accountants", appearing in subclause 4 - ALLOWANCE FOR QUALIFICATION of clause 8 - WAGE RATES, changed to "National Institute of Accountants". A copy of the relevant National Companies and Securities Commission "Certificate of Incorporation on Change of Name of Company" was submitted by Mr Brotherson in support of his application to amend1. Mr Fry, appearing for the Federated Clerks Union, Tasmanian Branch, agreed to the TCI's application. I endorse both parts of the TCI's application and the Award will be amended accordingly: the operative date to be from 25 January 1990 as indicated in my earlier decision. An order is attached.
