In this matter the Australasian Meat Industry Employees Union, Tasmanian Branch (AMIEU) requested the variation of the Meat Trades Award and the Abattoirs Award (the awards) to provide for the payment of TAFE fees required to be paid by apprentices. Mr Swallow for the AMIEU tendered exhibit S1 which indicated that apprentices are charged $50 per year made up as follows: $20.00 State Government levy $30.00 College fee for material and services provided. Mr Swallow submitted that various awards of this Commission contain similar provisions to those sought by the AMIEU. Mr Edwards for the Tasmanian Confederation of Industries (TCI) indicated that whilst TCI was sympathetic to the AMIEU claim, it should be considered within the parameters of the structural efficiency principle. He also submitted that the claim should be considered in relation to the requirements imposed by the Training Guarantee (Administration) Act. Mr Edwards brought to the attention of the Commission the "Training Leave" provisions included in the Metal Industry Award. These were included consequential to the finalisation of the structural efficiency review of that award. Mr Edwards urged the Commission not to act on this matter at this time but rather allow the parties further opportunity to more fully consider the variations sought. Whilst I support Mr Edwards in his request to provide more time to enable the parties to discuss how to best translate the claim into suitable award variations, I confirm that any variation in respect of payment of costs incurred by apprentices will operate from 21 August 1990. A draft order should be submitted for the consideration of the Commission no later than 9 November 1990 or commensurate with the finalisation of the review of the awards in line with the Structural Efficiency Principle, whichever is the earliest. As a guide to the parties I consider that the Metal Industry Award sets out the appropriate criteria that should be satisfied before any payment is made. The format in that award may of course be adapted to suit the particular circumstances in the Meat Industry.
