Wage Rates - State Wage November 1989 - Structural Efficiency Principle - Second Stage

REASONS FOR DECISION

The applicants in this matter sought to increase the wage rates contained in the two awards being the subject of application, in accordance with second stage of the structural efficiency principle.

In return it was submitted that the parties had agreed to the contents of two documents which were tendered as Exhibits ETU1 and ETU2 and titled "Award Restructuring Development and Implementation Proposal" and "Structural Efficiency Adjustments Tasmanian Public Sector".

I indicated to the parties that the two documents alone were not sufficient to grant the increases sought as their relevance was questionable to this group of employees especially given the submission presented by the unions that they had their own agenda for structural efficiency as opposed to that of the Operational Services Stream as enunciated in Exhibit ETU1.

On the next day of hearing the unions presented another exhibit (AMWU1) which was more program specific and centred around award restructuring for the two awards in question.

In summary that exhibit contained the following:

A.  By 23 November 1990 a skills audit would be completed. This audit would be on all skills held by current employees falling within the scope of the awards in question, thus enabling career paths to be developed along with training and skills acquisition programs.

B.  Prior to 20 December 1990 the parties will:

(a) Make application to the Commission for the making of a new award which will be an amalgam of the two awards subject to these applications.

(b) Report progress on a series of meetings outlined in Exhibit AMWU1.

C.  In January 1991 after the establishment of the new award the intention of the parties is to insert in that award a classification structure similar to the one contained in the Federal Metal Industries Award.

D.  By the end of February 1991 all employees will be translated to the new career path classifications.

I was also informed that it was the parties intention to continue with the existing award in terms of conditions of employment until 30 June 1991.

Having considered all the issues I have arrived at the conclusion that proposals contained in Exhibits ETU1 and 2 and AMWU1 and taken as a whole are sufficient to warrant the second structural efficiency increase and are in conformity with the Principles.

That being the case the award will be varied in accordance with the State Wage Case Decision, effective from the first full pay period to commence on or after 18 July 1990 being the date agreed to by the parties.

The parties are requested to prepare the Draft Orders for the consideration of the Commission.
