TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for award or variation of award

The Federated Miscellaneous Workers Union of Australia
Tasmanian Branch

(T.2715 of 1990)

MISCELLANEOUS WORKERS AWARD

COMMISSIONER P A IMLACH

16 November 1990

Award variation - superannuation

REASONS FOR DECISION

This was an application under Section 23 of the Act for an amendment to the Miscellaneous Workers Award (the Award) to add some further provisions in the Appendix to the Award concerning occupational superannuation.

The applicant was The Federated Miscellaneous Workers Union.

Mr K O'Brien appeared for the Union and produced an exhibit which he used to explain the amendments sought. He said that agreement had been reached as to the terms of the amendment and for the date of operation to be 13 November 1990.

One of the changes sought was the addition of a requirement that all employers bound by the Award become "participating employers" in the Award nominated fund, Tasplan.

The other change sought was the addition of a requirement that contributions commence to be paid after an employee has completed one month's continuous service.

There were also some minor consequential amendments sought.

Mr M Sertori appeared for the Tasmanian Confederation of Industries (the Confederation) and he confirmed the Confederation's agreement to the amendments proposed as detailed in the exhibit and the date of operation.

I endorse the agreement between the parties and the Award will be amended as requested operative from 13 November 1990.
