This matter concerns a reference pursuant to Section 63(10)(b) of the Act to determine the question of award interest.

The Federated Miscellaneous Workers Union of Australia, Tasmanian Branch (FMWU) lodged an objection to the National Union of Storeworkers, Packers, Rubber and Allied Workers, Tasmanian Branch (NUSPRAW) having an interest in the Fibreglass and Plastics Award.

During the course of a number of hearings the Commission encouraged the parties to confer and explore the conciliatory process as a mechanism for achieving a settlement to the dispute.

On 26 April 1990 both the FMWU and NUSPRAW indicated on transcript that they had reached an agreement on certain matters and that as a consequence the FMWU has withdrawn its objection to NUSPRAW having a registered interest in the Fibreglass and Plastics Award.

The terms of the agreement reached are contained in a signed document which shall remain part of the official file record of the Commission. In addition those terms and conditions are an integral part of my decision to grant the NUSPRAW the award interest sought, and are set out below:

    "In consideration for the FMWU agreeing to withdraw its objection to the NUW having a registered interest in the Fibreglass and Plastics Award it is agreed as follows:

    1. The parties to this agreement affirm their commitment to respect current and traditional areas of membership coverage in accordance with the National Agreement dated April 7th 1988 annexed hereto. .

    2. The NUW undertakes not to seek an interest in the Leather Canvas and Sheet Plastic Fabrication Award.

    3. The parties are committed in the event of a membership dispute to accept the ACTU demarcation procedures having exhausted inter-union consultation."

DATE OF EFFECT:

The NUSPRAW shall be granted award interest on and from the fourth day of June 1990.

ORDER:

The order varying the award to include NUSPRAW in the "Parties and Persons Bound" Clause is attached.
