Labour on-costs - 3% occupational superannuation

REASONS FOR DECISION

This was an application made by the Australasian Society of Engineers, Tasmanian Branch (the ASE) under Section 23 of the Act for the inclusion of an occupational superannuation clause in the Automotive Industries Award (the Award).

Mr J Long appeared for the ASE and he produced an exhibit which was a draft order for an amendment to the Award in terms agreed between the parties. The draft amendment was in a form similar to a number of occupational superannuation clauses already endorsed and included in other awards of the Commission.

Those representing the other unions present at the hearing all supported the submissions of the ASE and the agreed draft amendment. The representatives were Mr D Holden for The Vehicle Builders Employees Federation of Australia, Victorian Branch, Mrs H Dowd for the Federated Clerks Union of Australia, Tasmanian Branch, Mr D Harding for The Amalgamated Metal Workers' Union and Mr P Griffin for the Shop Distributive and Allied Employees' Association, Tasmanian Branch and the United Sales Representatives and Commercial Travellers' Guild of Australia, Tasmanian Branch.

There were two funds nominated in the draft amendment, TASPLAN and VISTA (the Vehicle Industry Superannuation Trust Australia), the latter being the nationally recognised vehicle industry fund. Mr Holden promised to send a copy of the relevant Commonwealth correspondence endorsing the VISTA fund and it has since been received.

Mr T Edwards, who appeared for the Tasmanian Confederation of Industries and the Metal Industries Association Tasmania, confirmed agreement to the application and the draft amendment to the Award.

There were three relevant dates for the implementation of occupational superannuation in the Award:

  • The date of operation of the whole amendment - 1 January 1991.

  • For the purposes of exemption applications the date other funds must have been in operation by - 1 June 1990.

  • The closing date for exemption applications - 31 January 1991.

All parties confirmed agreement to these dates.

As indicated at the hearing, I endorse the amendment to the Award and the date of operation.

I consider that the proposed amendment is entirely within the Wage Fixing Guidelines and its implementation is not against the public interest.

An order is attached.
