Structural Efficiency Principle - Special Cases

REASONS FOR DECISION

The applications which were forwarded to me for determination by the President following his "Arguable Case" findings in Anomalies Conference proceedings, were listed for hearing consequential to the decision of the Full Bench in the Public Sector Structural Efficiency Adjustment State Wage Case (T.2399, T.2508, T.2511, T.2586 and T.2605 of 1990).

The Bench stated, inter alia:

"7. We expect special case considerations to be accommodated during the hearings convened to deal with each occupational stream."

In the proceedings before the Commission as constituted in this matter, Mr Grey appearing for the Tasmanian Public Service Association and Mr Pearce appearing for the Minister administering the Tasmanian State Service Act 1984 consented to these special case matters being referred to the Full Bench for determination.

In the circumstances these applications are referred to the President pursuant to Section 24(4) of the Industrial Relations Act 1984.
