Wage Rates - State Wage Case November 1989 - Structural Efficiency Principle - Second Stage

REASONS FOR DECISION

This application was made by the Hospital Employees' Federation of Australia, Tasmania Branch now the Health Services Union of Australia, Tasmanian No. 1 Branch (HSUA) for the purpose of varying the Medical Practitioners (Private Sector) Award to reflect the second structural efficiency increase pursuant to the Principles.

The package presented by the parties included a series of faciliative provisions to be included in the award. They fell under the following headings:

ANNUAL LEAVE

By mutual agreement, leave may be taken in any combination providing one period is at least 14 consecutive days.

TIME OFF IN LIEU

By mutual agreement, an employee may take time off in lieu of:

Overtime
Saturday
Sunday
Public Holidays

Time to be at the penalty equivalent.

PAYMENT OF WAGES

By mutual agreement of a majority of employees, Electronic Fund Transfer and/or fortnightly pays may be implemented.

If E.F.T. is implemented, the employer shall pay the costs of E.F.T.

REFERENCE TO DISPUTES

Reference to "Secretary of Labour" changed to "Tasmanian Industrial Commission".

SICK LEAVE

During the first three months of employment, employees will not be able to take the full entitlement of sick leave.

ENTERPRISE FLEXIBILITY

An enterprise flexibility clause to be inserted in this award.

GENDER NEUTRAL

The award to be rewritten in gender neutral terms.

The Commission was also informed of the ongoing programme to examine the classifications, classification standards and career paths for employees under this award.

Mr P Targett of the Tasmanian Confederation of Industries (TCI) foreshadowed the employers intention to establish a new award or extend the existing award to accommodate work being carried out in the areas of pathology and radiology.

Having considered the submissions of the parties I have arrived at the conclusion that the package taken as a whole including the ongoing programme relating to classification structures, is sufficient to warrant the granting of the second structural efficiency increase and I decide accordingly.

This hearing will reconvene on 29 October, 1991, to consider the outstanding issues and ongoing programme outlined by the parties during the course of this hearing.

The orders giving effect to this decision are attached and the operative date will be from the first full pay period to commence on or after 16 September, 1991.
