s.23 application for award or variation of award

Electrical Trades Union of Australia,
Tasmanian Branch

(T.2805 of 1990)

PASMINCO ROSEBERY (MINING) AWARD

COMMISSIONER R.K. GOZZI

HOBART, 1 March 1991

Award variation - Tool Allowance

REASONS FOR DECISION

In this matter the Electrical Trades Union of Australia, Tasmanian Branch (ETU) requested the inclusion of Tool Allowance provisions in the Pasminco Rosebery (Mining) Award when that award is finally settled in respect of the transference of relevant conditions of employment from the Mining (Lead-Zinc) Award and when all outstanding issues in the new award are agreed between the parties and subsequently by the Commission.

The circumstances in respect of tool allowance are that employees, by consent of the employer and the ETU, intend to provide their own tools in lieu of having them supplied by Pasminco Mining-Rosebery.

Mr Becker for the ETU informed me that a comprehensive list of tools had been agreed with Pasminco and that these would be provided and maintained by employees consequential to the introduction of an appropriate allowance.

As indicated in the proceedings the application is endorsed and the variation will be operative from the first pay period to commence on or after 9 November 1990.

The parties are to submit a draft order for my perusal.
