Industrial Relations Act 1984
s.23 application to vary an award

Transport Workers' Union of Australia,
Tasmanian Branch

(T.2885 of 1991)

CARRIERS AWARD

COMMISSIONER P A IMLACH

15 February 1991

Wage Rates - State Wage November 1989 - Structural Efficiency Principle - second stage - minimum rates adjustment

REASONS FOR DECISION

This was an application to amend the Carriers Award made under Section 23 of the Act by the Transport Workers' Union of Australia, Tasmanian Branch (the Union). The Union sought to amend the Award to include minimum rates adjustments (MRA) in accordance with the current Wage Fixing Principles.

At the hearing Mr B Hansch, who appeared for the Union, produced two exhibits to assist in detailing the Union's application for the implementation of the second MRA which was foreshadowed in matter T.2598 of 1990 when the second Structural Efficiency Principle wage increase was endorsed along with the first MRA. Mr Hansch submitted that the increases ought to be endorsed as all the requirements of the MRA Guideline had been met. He requested that the date of operation of the amendment be the first full pay period commencing on or after 14 February 1991.

Mr S Clues appeared for the Tasmanian Confederation of Industries and confirmed agreement to the Union's application and to the operative date. He said that the application was consistent with the current Wage Principles in particular as six months had elapsed since the first MRA was implemented.

Mr J Blackburn, who appeared for the Australian Road Transport Industrial Organization, Tasmanian Branch also confirmed agreement.

I confirm that the application is in accordance with the Guidelines and the Award will be amended as requested to operate from the date agreed.

An order is attached.
