Wage Rates - Second Minimum Rates Adjustment - Application Granted - Operative Date F.F.P.P. on or after 1 May 1991

REASONS FOR DECISION

The decisions arising out of applications T.2818 of 1990 and T.2787 of 1990 and T.2799 of 1990 varied the Plumbers Award and the Building Trades Award to reflect the first Minimum Rates Adjustment in accordance with the Wage Fixing Principles. The operative dates of those decisions was from the first full pay period on or after 1 November, 1990.

These applications seek the second Minimum Rates Adjustment from the first full pay period on or after 1 May, 1991.

Exhibits were presented showing the agreed position of the parties, however, it was acknowledged that even though the shop fitter classification contained in the Building Trades Award was shown at the base tradesperson rate, its relativity to the base rate was being reviewed at a national level within the industry.

Mr Clifford representing the Building Workers Industrial Union of Australia, (Tasmanian Branch), foreshadowed that this specific item would be further debated when dealing with the application for the third Minimum Rates Adjustment.

During the hearing dealing with the first Minimum Rates Adjustments the Unions agreed that increases in wage rates arising out of Minimum Rates Adjustments could be absorbed against existing overaward payments and that no action will be taken by them to re-establish pre-existing level of over award payments. This agreement would also apply for this and future Minimum Rates Adjustments.

I am satisfied that the Minimum Rates Adjustment agreement presented by the parties complies with the Wage Fixing Principles and the Public Interest requirements of the Act. As a result I am going to grant the applications in the manner sought by the parties including the operative date.

The order giving effect to this decision is attached and I take this opportunity to remind the parties that the third instalment of the Minimum Rates Adjustment will not be automatic and will require a separate application.
