Labour on-costs - 3% occupational superannuation - exemption

REASONS FOR DECISION

This was an application made under Section 23 of the Act by the Tasmanian Confederation of Industries (the Confederation) for B.M.G. Resources (trading as Boral Quarries)(the Company) to be listed in the Quarrymens Award (the Award) as being exempt from the requirement to contribute to the Fund nominated in the superannuation clause of the Award; Tasplan. The alternate fund specified in the application was the Boral Employees Provident Fund.

Mr S Clues, who appeared for the Confederation, in support of the application confirmed that the alternate fund had been approved in accordance with the conditions laid down in the Commonwealth Occupational Superannuation Standards Act 1987 since 1986 and that the fund had been receiving contributions for employees covered by the Award prior to 1 August 1990. All this was in accordance with the requirement in the Award for those seeking exemptions.

The major union concerned, The Australian Workers' Union, Tasmanian Branch was represented by Mr D Hayes who advised agreement to the exemption sought.

I endorse the agreement between the parties and the Award will be amended as requested. The amendment will operate from the date of this decision. Order
