REASONS FOR DECISION

In a decision handed down on 10 October 19901 the Mechanical Engineers and Founders Award was varied to insert the first Minimum Rate Adjustment. This was operative from the first full pay period to commence on or after the date of that decision.

In this matter the applicant sought to vary the same award to reflect the second Minimum Rates Adjustment in accordance with the Wage Fixing Principles.

In doing so Mr P Baker, representing the Association of Draughting, Supervisory and Technical Employees, Tasmanian Branch, also requested the Commission to place the definitions, currently appearing in an appendix to the award, into the body of the award, namely Clause 7.

Level 1 - 122% of the highest rate paid to those supervised.
Level 2 - 115% of the highest rate paid to those supervised.
Technical - 107% of the rate paid for the employee's technical classification

      

The applicant also tendered an exhibit showing the result of applying the second Minimum Rates Adjustment to all levels i.e. from 1 - 14 inclusive.

This application and the submissions presented by Mr P Baker on behalf of the Unions had the full support of Mr S Clues from the Tasmanian Confederation of Industries.

Nothing contained in the submissions of the parties was contrary to the Wage Fixing Principles or the Structural Efficiency package endorsed previously by the Commission. That being the case the application is endorsed and the award will be varied in the manner sought by the applicant.

The operative date of this decision will be the first full pay period on or after 10 April, 1991. The Orders giving effect to this decision are attached and it should be noted that the definitions contained in the award prior to this decision have now been included as an appendix to the award to assist in the translation of former Classifications into the new classification structure as it now appears in Clause 7 - Definitions.
