REASONS FOR DECISION

In my Reasons for Decision1 in matter T.2417 of 1990 I endorsed a number of structural efficiency measures leading to the variation of the Technical and Further Education Staff Award.

The variations included an interim classification and salary structure, supported by a translation document, which became operative from the beginning of the first full pay period to commence on or after 2 January 1991.

As it transpired the translation documentation contained a number of errors which were sought to be rectified in these proceedings. Mr Brough appearing for the Tasmanian Technical Staff Society (the Society) explained that the errors had resulted in the award containing a number of salaries below those which had applied prior to the implementation of the rationalised classification and salary structure.

Mr Smyth, appearing for the Tasmanian Public Service Association and Ms McKenzie, for the Minister administering the Tasmanian State Service Act 1984, supported the submissions made on behalf of the Society.

Having regard to the submissions of Mr Brough and to the exhibits he tendered in support, I am satisfied that the variations he requested to be made to the award would only reflect those salaries which were in place prior to translation. Those particular salaries should have been carried forward in the interim rationalisation of the classification and salary structure in the award.

In the circumstances the award will be varied in the terms of the attached order, operative from the beginning of the first full pay period to commence on or after 2 January 1991.
