Alleged failure to adhere to Section 86(e) of the Industrial Relations Act 1984

REASONS FOR DECISION

In my decision dated 28 March 1991, after hearing submissionson this application I stated:

"it must be said, from the formal submissions presented to date, I could not establish any failure to observe section 86(e)of the Act."

The applicant requested that this matter be re-listed with application T.3155 of 1991 to enable them to place further submissions on this application. During the course of hearing application T.3155 of 1991 I would have to say once again that nothing was put to me that would have me believe the employer has failed to observe section 86(e) of the Act.

That being the case this application is now closed.
